Course Content

The aim of this course is to give the students basic insights in economic and finance law, with the view to providing to the students the necessary tools and reflexes to be able to assist companies or natural persons (either business or consumers) in the future on legal issues relating to economic and financial law. This course is thus highly recommended for the students opting for specialisation in economic law, but is also useful for students with a key interest in contract law and B2B / B2C relations.

This course analyses further the set of rules of law governing the set up and excercise in Belgium of an economic activity by a business in Belgium and the rules governing the relationship between companies or between companies and customers.

The following topics are amongst others addressed:

  • Description and sources of economic law and main actors,
  • Freedom of economic activity, access to economic activity
  • Means of companies:
    •     capital & financing 
    •     innovation & intellectual property
  • Behaviour on the market:
    •   competition (abuse of dominant position and agreements restricting competition)
    •   market practicies.
  • Consumer protection (abusive clauses, distant sale)

The financial system being crucial to a business activity and trade, the course also examines basic rules applicable to financing and payments.

Students are expected to be able to work with the legislative texts and gain insight into the subject matter as a result of the lectures and any notes taken during these lectures.

Learning Outcomes

General competencies

Students are:

  • acquainted with the basic concepts and main legal laws and regulations of economic and financial law ;
  • able to explain the studied concepts and have insight in the studied material;
  • able to demonstrate their understanding and  the practical and societal relevance of the studied concepts ; they are able to critically assess the studied concepts in light of the actual societal evolutions and problems;
  • able to make a logical and critical argumentation;
  • able to identify and solve classical and new problems arising for undertakings or customers.

Grading

The final grade is composed based on the following categories:
Written Exam determines 100% of the final mark.

Within the Written Exam category, the following assignments need to be completed:

  • Written exam with a relative weight of 100 which comprises 100% of the final mark.
