Course Content

Membership of the European Union has major consequences for public law at Member State level. Conversely the European Union legal order is itself inspired by concepts and principles that emanate from the various national legal orders. In this course these interactions are studied. After introducing a number of key concepts (such a central vs. shared administration and direct vs. indirect administration), the course looks at topical issues and developments. Substantial attention is paid to the technocratic nature of the EU and the specific challenges that this poses for administrative organization and judicial review. The course thus combines insights from EU constitutional law, EU administrative law and national (comparative) administrative law.

Four classes are organized with 'assisted teaching', meaning that a group of students does part of the teaching (e.g. discussing a particular CJEU judgement).

The textbook (K. LENAERTS and P. VAN NUFFEL (T. CORTHAUT (ed.)), EU Constitutional Law (OUP, 2021) (hardcover) of (OUP, 2022) (paperback) offers background reading for those unfamiliar with EU law, and a quick overview of some of the key subjects of the course. Main materials are, however, the PowerPoints, case law and legal doctrine posted on Canvas.

Learning Outcomes

Algemene competenties

At the end of the course, students should:

be familiar with the most important institutions, agents, concepts, procedures, rules and principles of EU administrative law;
gain insight in the relationship (interdependency) between EU and domestic (Member State) administrative law;
report on and critically assess developments in EU administrative law, especially recent case law of the CJEU;
carry out research, in group, on topical issues of European administrative law and report on their findings in a thorough paper.

The final grade is composed based on the following categories:

Within the Other Exam category, the following assignments need to be completed:

Open book exam with a relative weight of 1 which comprises 100% of the final mark.

Additional info regarding evaluation

Open book exam, with an essay question and case problem. The essay question and the fictious case have equal weight.
