Course Content
Membership of the European Union has major consequences for public law at Member State level. Conversely the European Union legal order is itself inspired by concepts and principles that emanate from the various national legal orders. In this course these interactions are studied. After introducing a number of key concepts (such a central vs. shared administration and direct vs. indirect administration), the course looks at topical issues and developments. Substantial attention is paid to the technocratic nature of the EU and the specific challenges that this poses for administrative organization and judicial review. The course thus combines insights from EU constitutional law, EU administrative law and national (comparative) administrative law.

Four classes are organized with 'assisted teaching', meaning that a group of students does part of the teaching (e.g. discussing a particular CJEU judgement).
Course material
Handbook (Recommended) : EU Administrative Law, Paul Craig, 3de, Oxford University Press, 9780198831655, 2018
Digital course material (Required) : Selected cases and materials, Canvas
Additional info

The textbook (P. CRAIG, EU Administrative Law, Oxford University Press, edition 2018) offers background reading for those unfamiliar with EU law, and especially EU administrative law. Main materials are, however, the PowerPoints, case law and legal doctrine posted on Canvas.

Learning Outcomes

General Competencies

At the end of the course, students should:

  • be familiar with the most important institutions, agents, concepts, procedures, rules and principles of EU administrative law;
  • gain insight in the relationship (interdependency) between EU and domestic (Member State) administrative law;
  • report on and critically assess developments in EU administrative law, especially recent case law of the CJEU;
  • carry out research, in group, on topical issues of European administrative law and report on their findings in a thorough paper.

Grading

The final grade is composed based on the following categories:
Other Exam determines 30% of the final mark.
SELF Teamwork determines 40% of the final mark.
SELF Presentation determines 30% of the final mark.

Within the Other Exam category, the following assignments need to be completed:

  • Onepager with a relative weight of 1 which comprises 30% of the final mark.

Within the SELF Teamwork category, the following assignments need to be completed:

  • Group paper with a relative weight of 2 which comprises 40% of the final mark.

Within the SELF Presentation category, the following assignments need to be completed:

  • Assisted teaching with a relative weight of 3 which comprises 30% of the final mark.

Additional info regarding evaluation

The evaluation combines portfolio assessment with participation in class.

Students are evaluated on the basis of their efforts for the 'assisted teaching' (30%).

On top of that, students write a research paper (40%) in groups of 2 or 3.

Finally, a onepager (30%) is due at the end of December. Students get a statement to evaluate, via which they can demonstrate their knowledge of what was covered in class.

Allowed unsatisfactory mark
The supplementary Teaching and Examination Regulations of your faculty stipulate whether an allowed unsatisfactory mark for this programme unit is permitted.
