Course Content

1. The course consists of two parts: a general part and a specific part:

  • In the general part, some specific characteristics and concepts from economic and financial criminal law are explained, including the criminal liablitiy of legal persons, the administrative enforcement and the civil action for the cessation of criminally punishable offences. 
  • In the specific part, several economic and financial criminal acts, both from book II of the Code of Criminal Law (e.g. money-laundering and private bribery) as from specific criminal by-laws (e.g. commercial practices and insider trading), are studied. 

2. Two parts of the course are the subject of self-study: one related to the criminal liability of legal persons, and one related to the offences related to insolvency. The self-study consists of answering two questions for each part.

General competencies

1. To duly highlight the specific nature of economic and financial criminal law, holding its own typologies of incrimination, investigation and punishment.

2. To duly highlight the specific finality of economic and financial criminal law, which principally consists in the restoration of the economic order that was disrupted.

3. To duly highlight the evolving nature of economic and financial criminal law, considering the evolution of economic law and economic life in large. 

The study of economic and financial criminal law comprises both criminal law aspects as well as criminal procedural law aspects. 

Grading

The final grade is composed based on the following categories:
Oral Exam determines 100% of the final mark.

Within the Oral Exam category, the following assignments need to be completed:

  • Examen Mondeling with a relative weight of 100 which comprises 100% of the final mark.

Oral examination with written preparation. 

Legislative texts, non-annotated, may be used during the written preparation of the exam, but not during the oral continuation.
