This course aims at providing the students with basic concepts of the law of the European Union (EU), with a focus on the institutional aspects thereof. Aspects of material EU law may be used to illustrate certain topics, but are rather dealt with in the course European Law II, which covers inter alia the internal market.
First and foremost, European integration is analysed from an historical perspective, discussing the main stages from the European Coals and Steel Community (ECSC) to the Lisbon Treaty.
Furthermore, the composition, organisation and competences of all EU institutions are analysed: European Parliament, European Council, Council of the EU, European Commission, Court of Justice of the EU, European Central Bank and Court of Auditors.
In addition, EU acts are discussed. Also, how do European regulations, directives and decisions come about, what is the legal status of the EU Charter of Fundamental Rights (and the general principles of EU law)? In that regard, attention will be given to the relation between national law and EU law. The essential constitutional principles of primacy and direct applicability of EU law in the national legal order will be discussed in detail.
Finally, the focus will be on the topic of legal remedies in the EU. In that regard, will be analysed the infringement procedures against Member States for non-compliance with EU law, the preliminary ruling procedure before the European Court of Justice as well as direct actions against legal acts of the EU institutions.
In the first lecture students are provided woth information about the content and the learning outcomes of the course, the study materials and the evaluation method.
The final grade is composed based on the following categories:
Written Exam determines 100% of the final mark.
Within the Written Exam category, the following assignments need to be completed:
Written exam on both knowledge and insight (which may be in the form of multiple choice questions). During the exam, the students may use "Europese Basisteksten" or another edition of these texts. Nothing may be written in them, except for colour markings and underlingin. No post-it's are allowed.
