Course Content

The course deals with:

  1. Access to the Belgian labour market for foreign workers
  2. Free movement of workers in the European Union
  3. Determination of the applicable social security legislation, in particular (EU Regulation 883/2004)
  4. Determination of the labour legislation according to international, European and Belgian law
  5. Dispute regulation and cross-border employment.

After following the course, students have a thorough knowledge of labour and social security law related to cross-border employment and a good comprehension of other legal aspects related to this issue.

Particular attention will be paid to the case law of the European Court of Justice. During the classes, students will learn how to resolve concrete cases.

Learning Outcomes

General competencies

Students: 

  • gain an insight into particular problems of HR resulting from cross-border employment.
  • acquire a thorough knowledge of the labour law and social security law related to cross-border employment and gain insight into the connection between that law and other legal aspects of this kind of employment.
  • know different categories of cross-border employment and the techniques applied by different branches of the law in this regard.
  • can compare those categories and techniques and understand the relationship between them.
  • are proficient in applying the relevant legal sources.
  • can situate factual situations in the applicable legal categories and can legal issues arising from cross-border employment
  • acquire the frame of reference and the skills required to integrate autonomously new knowledge with regard to legal issues related to cross-border employment.

The final grade is composed based on the following categories:
Oral Exam determines 100% of the final mark.

Within the Oral Exam category, the following assignments need to be completed:

  • Oral Exam with a relative weight of 1 which comprises 100% of the final mark.
