Course Content

The course consists of two main parts. On the one hand, the course examines legal issues on human resources management,  on the other hand, the course studies legal issues related to the reorganisation of undertakings.

In part one will be studied:

  • Topics regarding the process of recruitment (applicants’ rights and obligations, discrimination, trail running, privacy protection)
  • Recruitment and types of labour contracts
  • Drawing up the labour contract
  • Lending out workers in shared services and company groups
  • Wage notion and wages policy
  • Organisation of labour.

In part two will be studied:

  • types of reorganisation depending on the continuity or liquidation of the enterprise
  • transfer of undertakings (notion, consequences, …)
  • collective redundancies (information and consultation procedures; dispute settlement)
  • closure of undertakings (notion, consequences, information and consultation procedures …)
  • judicial reorganization (employees’ rights depending on the type of reorganization, mechanisms to protect employees against their employer’s insolvency, etc.

Topics of both parts will be spread equally over the number of classes.

Students needs also a codification of legislation. Recommended is Basiswetboek Sociaal Recht voor studenten, Wolters Kluwer, most recent edition, to be completed by the students with the relevant EU-directives.

Learning Outcomes

General competencies

By the end of this course, students:

  • have obtained a specialized and cross-border knowledge and comprehension of the major legal issues on human resources management and the legal status of employees in the event of the restructuring or closure of undertakings;
  • are able to apply the discussed doctrine on practical cases.

Grading

The final grade is composed based on the following categories:
Oral Exam determines 100% of the final mark.

Within the Oral Exam category, the following assignments need to be completed:

  • Oral Exam with a relative weight of 1 which comprises 100% of the final mark.
